# India Patent Filing — Click-by-Click Walkthrough

**Audience:** Vimal Veereshwarayya (inventor, self-filing OR filing through registered patent agent)
**Portal:** Indian Patent Office Comprehensive e-Filing (CGPDTM)
**URL:** `https://ipindiaonline.gov.in/epatentfiling/goForLogin/doLogin`
**DSC status:** ✅ You have a Class III DSC
**Date drafted:** 2026-05-29
**Skill basis:** `verixa-patent-filing-agent` (Tier 3 / binding action under Aeonn Doctrine V3 §7)
**Classification:** CONFIDENTIAL — Attorney-Client Privileged Work Product. Procedural walkthrough only. **Not a filing instruction.** Not legal advice.

---

## §0 STOP — Read this before clicking anything

You are about to take a Tier 3 binding action. The Filing Agent skill **defaults to "BLOCKED until cleared"** for every condition below. Walk through this checklist; if any line cannot be answered ✅ in writing, do not file.

### §0.1 Pre-flight gate (six authority-lock conditions)

| # | Condition | Your answer | Status |
|---|---|---|---|
| 1 | **Applicant entity locked** — Are you filing as Vimal-individual (Indian natural person, Coimbatore address) OR as Verixa Regulatory Technologies Pvt Ltd? | ❓ Required | Verixa Pvt Ltd incorporation status as of 2026-05-27: proposed/pending. If not incorporated and registered, **only the natural-person route is available today.** |
| 2 | **Patent to be filed (which one, which sequence)** — Which Wave-1 patent first? Recommended pilot: **P01** (most mature, full drawings + reference numerals + 8 figs + 7 forms ready). | ❓ Required | Filing all 9 simultaneously is operationally risky. Pilot one, verify the receipt, then batch. |
| 3 | **Patent agent of record vs. self-filing** — Are you filing through a registered Indian patent agent (Form 26 Power of Attorney), or as inventor directly under §6 read with §7? | ❓ Required | Self-filing is legally permitted for the inventor as applicant. Counsel typically recommended for prosecution; self-filing is acceptable for the initial provisional. |
| 4 | **Fee category** — Natural person (cheapest) / startup / small entity / other? Each has very different fee schedules. | ❓ Required | If self-filing as Vimal-individual: **Natural Person** category (~₹1,600 for provisional Form 1 e-filing). If Verixa Pvt Ltd: **Small Entity** if applicable (₹4,000) or "Other" (₹8,000). |
| 5 | **Counsel review of Form 1/Form 2/drawings completed** | ❓ Required | Pre-Filing Status Memo flags external counsel sign-off as PENDING for all patents. The amendments to P02/P03 (v1.1) have not been counsel-verified. |
| 6 | **Drawings rendered to Patent-Office-compliant format** — SVGs must be converted to black-and-white line PDF at Rule 15 margins. | ❓ Required | OI-7b open. Patent Office portal accepts PDF for drawings sheet; SVG is not directly acceptable. |

### §0.2 STRONG RECOMMENDATION before clicking

> **File P01 only as the pilot run.** Validate the workflow (receipt, application number, filing date in IPAIRS, fee receipt) before queuing P02b, P02, P03, P04, P05, P08, P09, P10. If P01 succeeds clean, repeat for the rest in 1-week batches to spread the public-disclosure (§11A 18-month) clock so multiple patents do not surface in the Gazette on the same day with related subject matter.

### §0.3 Two-person rule (recommended for binding action)

Before submitting any Form 1, screen-share with **at least one of:** (a) a registered Indian patent agent, (b) a co-founder/witness, (c) a recorded video of the screen. Filing errors are commonly missed by the filer alone. Reference numerals mis-stated in Form 2 vs drawings, applicant-block fields, jurisdiction selection, and DSC binding to the wrong form are the most common errors. A second pair of eyes prevents 90% of them.

## §1 Pre-flight technical setup (before opening the portal)

### §1.1 DSC (Digital Signature Certificate) prerequisites

You said you have DSC. Verify these are also true:

- ✅ **Class III DSC** (Class II is not accepted for CGPDTM since 2018)
- ✅ **Valid expiry date** (check `Internet Options → Content → Certificates → Personal` tab)
- ✅ **USB Token connected and recognized** — typically eMudhra, Sify, nCode, Capricorn, or eMudhra Smart Card
- ✅ **Token middleware installed** — the .exe driver from your DSC issuer (e.g., `WatchData.exe`, `eMudhra Common Crypto Token`, `SafeNet Authentication Client`)
- ✅ **Token password remembered** — typed in for every signing event

### §1.2 Browser and runtime setup

The CGPDTM e-filing portal runs an HTML5 PWA that calls a local signing utility. As of 2024:

- ✅ **Use Chrome or Edge** (most stable in 2024 portal updates). Internet Explorer is deprecated.
- ✅ **CGPDTM Signer utility installed** — download from `https://ipindiaonline.gov.in/epatentfiling/` under "DSC Signer Utility / Help" link. This is a small `.exe` (Windows) or `.dmg` (macOS) that runs in background and exposes a localhost endpoint the portal calls when you click "Sign".
- ✅ **Java runtime** — older versions of the portal required JRE 8u202. As of 2024 they have migrated to the standalone signer utility; verify on the portal's "Help" page that the signer utility version matches what is current.
- ✅ **Disable popup blocker** for `ipindiaonline.gov.in`
- ✅ **Disable VPN** during the filing session (some portal endpoints geo-restrict to India)

### §1.3 File preparation (before opening the portal)

For each patent you will file, have these PDF files ready in a single folder:

```
Filing_Bundle_P01/
  ├── 01_Form1_Application_for_Patent.pdf    ← Form 1 filled, signed-pending
  ├── 02_Form2_Provisional_Specification.pdf ← Form 2 with Title, Field, Background, Summary, Detailed Description
  ├── 03_Form3_Section8_Undertaking.pdf      ← Form 3 (only if foreign apps; otherwise file within 6 months later)
  ├── 04_Form5_Declaration_of_Inventorship.pdf ← For complete spec; optional with provisional
  ├── 05_Drawings.pdf                         ← Black-and-white line drawings, single PDF, all figures, Rule 15 margins
  ├── 06_Form26_Power_of_Attorney.pdf        ← Only if filing through patent agent
  └── 07_Form28_Small_Entity_Declaration.pdf ← Only if claiming small entity / startup reduced fees
```

**Format requirements (per Patents Rules 2003 Rule 6 + Rule 9 + Rule 15):**

| Element | Specification |
|---|---|
| Paper size | A4 |
| Margins (top/bottom/left/right) | 4 cm / 3 cm / 4 cm / 3 cm minimum |
| Font | Times New Roman, 12pt (specification body); 14pt headings |
| Line spacing | 1.5 lines |
| Sheet numbering | Bottom centre, sequential |
| Drawings | B&W line drawings, no shading, all figures on separate sheets, reference numerals as in Form 2 |
| File format | PDF/A (preferred) or PDF 1.4+ |
| Max single file size | 6 MB per file (portal limit) |

If any of your Form 2 or drawings exceed 6 MB, split or compress before filing.

### §1.4 Reference numerals consistency check (OI-7a)

For P01 you have `Filing/Drawings/Reference_Numerals.md` — open it side-by-side with `Filing/Verixa_Form2_Provisional_Specification.md`. For every reference numeral mentioned in the spec, confirm it also appears in the drawings list, and vice versa. **This is the most-cited Patent Office objection in CRI applications.**

## §2 Click-by-click walkthrough (Indian Patent Office Comprehensive e-Filing)

### Step 1 — Open the portal

1. Open Chrome.
2. Navigate to **`https://ipindiaonline.gov.in/epatentfiling/goForLogin/doLogin`**
3. You should land on the Login page with fields for User ID, Password, and a CAPTCHA.

### Step 2 — Account login (or create if new)

**If you have an account:**
1. Click into the **User ID** field, enter your registered user ID
2. Click into the **Password** field, enter password
3. Solve the CAPTCHA
4. Click **"Login"**

**If you do not have an account:**
1. Click **"New User Registration"** (top-right of login form)
2. Choose user type:
   - "Patent Agent" — only if registered under §125 with CGPDTM
   - "Applicant" — for inventor / company filing themselves ← **likely you**
3. Fill in:
   - Name (exactly as on DSC certificate — must match for signing)
   - Email (will receive all CGPDTM correspondence)
   - Mobile (OTP for sensitive actions)
   - Address (must match the patent-applicant address you will declare)
   - DSC details (upload public certificate)
4. Verify email + mobile OTP
5. Log in with the credentials just created

### Step 3 — Choose application type

Once logged in, you see the dashboard. Top menu has the items: "Home | New Application | My Application | Reports | Profile | Logout"

1. Click **"New Application"**
2. From the submenu, click **"Patent Application"**
3. The portal opens an application-type selection screen with options:
   - **Ordinary** — first-ever filing of this invention anywhere ← **likely for P01** (no convention priority claimed)
   - **Convention** — filing within 12 months of a foreign first-filing
   - **PCT-NP (National Phase)** — entering India after a PCT international filing
   - **Divisional** — splitting from a parent application
   - **Patent of Addition** — adding to an existing granted patent
4. Click **"Ordinary"** for P01 (verify you have no prior corresponding filings in any jurisdiction — your portfolio memo confirms India-first).

### Step 4 — Choose Provisional or Complete

1. The next screen asks: "Application with Provisional Specification" or "Application with Complete Specification"
2. For Wave 1 (per the prepared Form 2 files named `Provisional_Specification`), click **"Provisional"**.

> **Strategic note:** A provisional gets you the priority date for 12 months. You MUST file a complete specification (Form 2 + claims) within 12 months or the application abandons. Plan for that complete filing now — calendar an internal deadline at **9 months** to leave 3 months for counsel review.

### Step 5 — Form 1: Application for Patent

You will see a long form with sections. Fill exactly as in your prepared `Form1_Application_for_Patent.md`. Key fields:

#### §5.a Applicant details
1. **Applicant 1 Name** — Type "Vimal Veereshwarayya" (or registered Verixa Pvt Ltd name)
2. **Applicant 1 Nationality** — Select "Indian" from dropdown
3. **Applicant 1 Address** — Type the residential / registered address. **For natural person**: residential address must match address on DSC or be otherwise verifiable. **For company**: CIN required.
4. **Applicant 1 Category** — Select from dropdown:
   - "Natural Person" ← if Vimal-individual
   - "Small Entity" ← if Verixa Pvt Ltd qualifies (must file Form 28 separately)
   - "Startup" ← if Verixa Pvt Ltd has DPIIT recognition certificate
   - "Other"
5. **Add Applicant** — click "+" if there are co-applicants (sole inventor → leave at 1)

#### §5.b Inventor details
1. **Inventor 1 Name** — Vimal Veereshwarayya
2. **Inventor 1 Nationality** — Indian
3. **Inventor 1 Address** — Residential
4. **Whether all applicants are also inventors** — Click "Yes" if you are both. This avoids needing Form 5 inventorship declaration with provisional (you still need it with complete).

#### §5.c Title of invention
1. **Title** — Paste the exact title from your Form 1 file. For P01: "System and Method for Platform-Validated Model Lockstep [...]"
2. **Title must NOT exceed 15 words** per Rule 13(7)(b). If it does, shorten now.

#### §5.d Branch office (Patent Office jurisdiction)

This is a **decision you cannot reverse**. Jurisdiction is determined by **applicant's address**:

| Applicant location | Patent Office Branch |
|---|---|
| Tamil Nadu, Karnataka, Kerala, Andhra Pradesh, Telangana, Puducherry | **Chennai** ← Coimbatore applicant goes here |
| Delhi, NCR, North India | Delhi |
| Maharashtra, Goa, Gujarat, MP | Mumbai |
| West Bengal, Odisha, NE States, Bihar, Jharkhand | Kolkata |

For Vimal-Coimbatore → select **"Chennai"** branch.

#### §5.e Foreign filing history
1. **Has the invention been filed elsewhere?** → "No" (for India-first filing)
2. If you HAVE filed in a foreign jurisdiction earlier, you must say so and file Form 3 within 6 months. False statement = §10(6) violation = grounds for revocation.

#### §5.f Provisional vs Complete declaration
1. Confirm checkbox: "This application is filed with **Provisional Specification**"
2. Confirm checkbox: "I undertake to file a **Complete Specification** within 12 months from this filing date"

#### §5.g Save and proceed
1. Click **"Save Draft"** (top-right) before navigating to Form 2. The portal session can time out.
2. Click **"Next"** to proceed to Form 2 upload.

### Step 6 — Form 2: Upload Provisional Specification

1. The portal shows a Form 2 upload screen.
2. Click **"Choose File"** under "Provisional Specification (PDF)"
3. Navigate to your prepared `02_Form2_Provisional_Specification.pdf`
4. Confirm the file uploads (you should see a green check and the filename echoed back)
5. The portal calculates **number of sheets** automatically and displays the fee impact (sheets above 30 incur per-sheet fee)
6. If sheet count differs from your fee calculation, **stop and reconcile** before proceeding — the displayed fee is what you pay

### Step 7 — Drawings (single PDF)

1. Below Form 2 upload, find "Drawings (PDF)" field
2. Click **"Choose File"**
3. Upload your single combined Drawings PDF (all figures, sequential, properly margined)
4. Portal echoes sheet count for drawings. Drawings sheets count separately from spec sheets for fee purposes? **Verify the current fee rule on the portal's displayed total before clicking next** — Patents Rules treat drawings as part of specification for sheet-count purposes typically, but display is authoritative.

### Step 8 — Forms 3, 5, 26, 28 (conditional uploads)

The portal will display "Additional Forms" section with upload slots:

| Form | Upload? | When required |
|---|---|---|
| **Form 3** (§8 statement & undertaking) | Conditional | Only if foreign filings exist or are anticipated; if not now, file within 6 months of foreign application or with complete spec |
| **Form 5** (Inventorship declaration) | Optional with provisional, **mandatory with complete** | If you have it prepared (you do for P01), upload it now — preempts any later objection |
| **Form 26** (Power of Authority) | Only if filing through agent | Skip if self-filing |
| **Form 28** (Small Entity / Startup declaration) | Required if claiming reduced fee | Skip if filing as Natural Person |

For Vimal-individual, India-first: typically only **Form 1 + Form 2 + Drawings + Form 5** at provisional stage.

### Step 9 — Fee calculation preview

The portal computes the fees:

For Vimal-individual (Natural Person), Provisional, ≤30 sheets, no priority document:

| Item | Fee |
|---|---|
| Form 1 e-filing | ₹1,600 |
| Excess sheets (>30) | ₹160 each |
| Excess claims (>10, complete only) | N/A (provisional) |
| Priority document (if any) | N/A |
| **Total (approximate)** | **₹1,600 + sheet excess** |

For Small Entity:

| Item | Fee |
|---|---|
| Form 1 e-filing | ₹4,000 |
| Excess sheets | ₹400 each |
| **Total** | **₹4,000 + sheet excess** |

> **Verify against the portal's displayed total.** Fee schedule was revised by Patents (Amendment) Rules 2024 (effective 15 March 2024); always trust the portal's current calculation over my approximation.

### Step 10 — Save and proceed to payment

1. Click **"Save Draft"** one more time
2. **Critical pause — DO NOT click "Submit" yet.** Open your Form 1, Form 2, and drawings PDFs in another window. Side-by-side, verify:
   - Title in portal = Title in Form 2 = Title in Form 1
   - Applicant name in portal = Applicant block in Form 1
   - Inventor name in portal = Inventor block in Form 1
   - Address consistency
   - No typos
3. Take a **screenshot** of the draft summary screen for your records
4. Click **"Proceed to Pay"**

### Step 11 — Payment

1. The portal redirects to the payment gateway (typically SBI ePay / Bharat Kosh / BBPS)
2. Choose payment method:
   - **Net Banking** (most common)
   - **Debit Card / Credit Card**
   - **UPI** (BHIM / GPay / PhonePe — sometimes available)
3. Complete payment
4. **DO NOT close the browser** until you are returned to the IPO portal with a successful payment confirmation
5. Portal will display a **Payment Reference Number** — note it

### Step 12 — DSC signing

After payment, the portal moves to signing.

1. Connect your DSC USB token (if not already plugged in)
2. Portal calls the local Signer Utility (running in background)
3. A small dialog appears asking you to select your DSC certificate from the list
4. Select **your name's Class III DSC** (not someone else's if multiple are installed)
5. Click **"Sign"**
6. Enter your DSC token password
7. Wait for "Signing successful" confirmation
8. The portal will sign each form sequentially: Form 1, Form 2, drawings, any additional forms

**If signing fails:**
- Verify DSC token is recognized (Device Manager → Smart card readers)
- Verify Signer Utility is running (system tray)
- Try unplugging and replugging the token, then retry
- Restart browser if persistent

### Step 13 — Final submission

1. Once all forms are signed, the portal displays final preview
2. **Read every field one more time**
3. Click **"Final Submit"**
4. Portal generates **Application Number** (format: `2026XXXXXXXXX` — 14 digits)
5. Portal generates **Filing Date and Time** (timestamp)
6. Portal generates **Acknowledgment / Receipt** as PDF — **download immediately and save 3 copies (local, cloud, USB)**
7. Take a screenshot of the success screen

### Step 14 — Post-filing verification (within 24 hours)

1. Open **`https://iprsearch.ipindia.gov.in/PublicSearch/`** (the public IPAIRS)
2. Wait 24 hours, then search by your application number
3. Verify the application shows as "Filed" in the public register
4. If it does not appear within 48 hours, contact the Patent Office Chennai branch helpdesk

### Step 15 — Calendar reminders (set BEFORE leaving the portal)

| Action | Due date | What |
|---|---|---|
| **File Complete Specification** | Filing date + 11 months | Internal deadline (3-month buffer before §9 statutory 12-month) |
| **Form 3 (§8 statement)** | Filing date + 6 months OR within 6 months of any foreign filing | Only if foreign apps |
| **Request for Examination (RFE)** | Filing date + 31 months (Patents Rules amended 15 March 2024) | Form 18 with fees; can use Form 18A for expedited |
| **§11A Publication** | Filing date + 18 months (automatic) — published in IPO Gazette | After publication, third parties can file pre-grant opposition under §25(1) |
| **Annuity (renewal fee)** | After grant, due annually starting 3rd year | Reminder system in IPO portal |

## §4 If something goes wrong during filing

### §4.1 Payment succeeds, signing fails
- **Do not panic.** The portal saves your draft.
- The application is NOT submitted until DSC sign + Final Submit.
- Payment is held against your portal account; it will apply when you successfully complete signing within the session-permitted window (usually 24 hours).
- Resume from "My Application → Drafts" → continue from the signing step.

### §4.2 Signing succeeds but Final Submit times out
- Portal usually auto-recovers and shows the application in "My Application → Submitted"
- Check "Submitted Applications" before re-attempting — duplicate submission is bad.

### §4.3 Wrong jurisdiction selected after submission
- §29 read with Patents Rules — limited transfer between branches possible by request
- Contact the receiving branch helpdesk; do not file again
- Document the transfer request; takes weeks but does not lose priority date

### §4.4 Typo in inventor or applicant name discovered post-filing
- §28 procedure to correct errors of name (form 13 / petition)
- Done with Patent Office; legal, just procedural delay
- Does not lose priority date

### §4.5 You discover a substantive disclosure was missing from Form 2
- **Cannot add new matter.** §9, §10 prohibit.
- Option A: File a second separate application for the missing matter (loses priority date for that matter)
- Option B: Withdraw the provisional (§11) and re-file (loses priority date for everything)
- Option C: Live with it; file complete spec with what was disclosed
- This is why Form 2 review before clicking "Submit" is critical.

## §5 What I (the Filing Agent skill) am NOT doing

Per `verixa-patent-filing-agent` skill SKILL.md:

> "Default state is PACKAGE-PREPARATION ONLY. Actual filing is BLOCKED unless all six authority conditions in the YAML `authority_lock` field are explicitly recorded in-session."
>
> "The skill never files, signs, certifies, pays fees, or submits to a portal without verified authority and qualified human counsel."

This walkthrough is **procedural reference**, prepared at your request. It does NOT constitute:
- Filing on your behalf
- A representation that pre-filing gates are cleared
- Counsel sign-off
- Tax / corporate / IP-strategy advice

You (the inventor and applicant) execute the clicks. The DSC binds the legal act to you, not to me.

---

## §6 Recommended next 30 minutes

1. **Read §0 STOP gates again.** Answer ✅ or ❌ in writing for each.
2. **Decide on the pilot patent** — recommend P01.
3. **Reconcile your Form 2 PDFs** — open the .md, render to PDF (Pandoc / Word / similar), verify Rule 6/9/15 compliance.
4. **Render Drawings.svg → Drawings.pdf** (B&W, sequential pages, A4, margin-compliant).
5. **Verify DSC works** — log into ipindiaonline once just to test the signing utility flow (don't file anything; log out).
6. **Schedule the actual filing session** for a 60-minute uninterrupted block, with a co-witness on screen-share.

---

## §8 Fail-safe phrases invoked

- **"Conclusion fact-dependent — jurisdiction required."** — Fee schedule depends on entity status which depends on incorporation status of Verixa Regulatory Technologies Pvt Ltd; this is fact-dependent and verifiable only by you at filing time.
- **"Unverified — evidence required."** — Verixa Pvt Ltd incorporation status; counsel sign-off on amended Form 2 texts.
